IMPORTANT: This is a limited product warranty. Unless expressly stated otherwise below, shipping, freight, delivery, removal, installation, reinstallation, diagnostic labor, service labor, travel, lifts, cranes, scaffolding, electrical work, permits, taxes, and access costs are not included and are the owner’s responsibility.
Scope and eligibility
This Limited Warranty applies to qualifying aluminum pergola and sunshade-system components distributed and sold by enVision and identified in an enVision customer contract that incorporates this warranty. It applies only to the original consumer purchaser named in that contract, is not transferable except where applicable law requires otherwise, and covers qualifying installations located within the continental United States. Commercial, resale, rental, common-area, dealer, and demonstration installations are excluded unless enVision agrees otherwise in a signed writing.
Each warranty period begins on the date enVision’s installation is substantially completed. Payment in full does not postpone or restart the warranty period; however, enVision has no obligation to process or perform a warranty remedy while any amount due under the customer contract remains unpaid.
Covered components and warranty periods
Coverage is limited to defects that existed in materials or factory workmanship and that first become apparent during the applicable period. Installation services are not covered by this product warranty unless a separate signed provision in the customer contract expressly states otherwise.
Structural aluminum components — 20 years
Factory defects in the aluminum posts, beams, gutters, louvers, brackets, pins, rods, and springs that cause the component to fail its ordinary structural function.
Qualifying powder-coat finish — 10 years
Peeling, flaking, blistering, or loss of adhesion caused by a factory-application defect. Color variation and the environmental conditions listed under Exclusions are not covered.
enVision-supplied pergola motors — 5 years
Factory defects in the motor. Controls, wiring, batteries, sensors, and damage caused by power conditions, water intrusion, or improper electrical work are excluded unless separately listed as covered.
enVision-integrated LED lighting — 5 years
Factory defects in qualifying LED strips and enVision-supplied drivers or controls, subject to the electrical and environmental exclusions below.
Heaters — Manufacturer’s stated period
Covered only under the heater manufacturer’s separate written warranty. enVision does not independently warrant heaters.
Motorized screens and fans — Manufacturer’s stated period
Covered only under the applicable manufacturer’s separate written warranty. enVision does not independently warrant screens or fans.
Other accessories or third-party products — Manufacturer’s stated period, if any
Covered only under the applicable manufacturer’s separate written warranty unless an enVision contract expressly identifies separate enVision coverage.
Exclusive limited remedy
For a timely and valid claim, enVision may, at its option, repair or refinish the covered defective component, provide a replacement component of comparable quality, or refund the amount originally paid to enVision for that component. If the component price was not separately itemized, the refund will be a reasonable allocation of the original product price based on enVision’s contemporaneous component pricing. The remedy applies only to the defective component and does not include a refund of design, engineering, permitting, installation, electrical, accessory, tax, financing, shipping, or service charges.
TO THE FULLEST EXTENT PERMITTED BY LAW, SHIPPING AND ALL LABOR ARE EXCLUDED. The owner is responsible for all freight, delivery, removal, installation, reinstallation, diagnostics, service calls, travel, access, lifts, cranes, scaffolding, electrical work, permits, taxes, and similar expenses, whether the claim is administered by enVision or another manufacturer. enVision will not reimburse work arranged by the owner.
A repaired or replacement component is covered for the remainder of the original component’s applicable warranty period or ninety days from delivery of the repaired or replacement component, whichever is longer. Replaced components become enVision’s property if enVision requests their return and provides return instructions; return freight remains the owner’s responsibility.
enVision may discontinue or modify products, components, designs, or colors. An exact visual or color match is not guaranteed. A comparable component may differ in appearance, dimensions, controls, technology, or finish while providing substantially similar function.
Owner use and maintenance requirements
Cleaning. Keep louvers, troughs, drains, and gutters free of leaves, dirt, rocks, branches, animal debris, and other obstructions. Clean the system with fresh water or a mild detergent as directed in enVision’s then-current care instructions, particularly after salt, hard-water, chemical, or dirt exposure.
Operation. Fully open and close each motorized or manual louver system at least once each month unless operation would be unsafe or contrary to written storm instructions.
Lubrication. Inspect and, where the applicable care instructions require it, lubricate designated motor and louver-pin points at least annually using the method and product stated in those instructions. The owner must not open, disassemble, or internally lubricate a sealed motor.
Electrical protection. Maintain wiring, connections, controls, drivers, and enclosures in a code-compliant, weather-resistant condition. Electrical work must be performed by a properly qualified person where required by law.
Storm preparation. Place louvers in the open position before forecast or observed winds exceed 60 mph, or at any lower threshold stated in the project-specific engineering, operating instructions, or governmental requirements. Disconnect power and follow all project-specific storm instructions when safe to do so.
Failure to perform a maintenance or operating requirement does not automatically void the entire warranty. enVision may deny coverage only to the extent the failure caused, accelerated, or materially contributed to the claimed defect or prevented enVision from reasonably evaluating it. The owner should retain reasonable maintenance records.
Exclusions
Property movement. Settlement, shrinkage, movement, vibration, distortion, failure, or modification of the home, building, deck, slab, balcony, roof, wall, foundation, waterproofing, flooring, or other supporting property.
Weather and external events. Hurricanes, tropical storms, tornadoes, lightning, hail, flood, fire, explosion, earthquake, windborne debris, extreme wind, power surge, utility interruption, impact, collision, vandalism, civil disturbance, animals, pests, or other events beyond enVision’s reasonable control.
Environmental exposure. Normal weathering, fading, chalking, color change, oxidation, corrosion, rust staining, mildew, mineral deposits, hard water, salt or coastal exposure, pollution, airborne contaminants, chemicals, fertilizers, pesticides, pool chemicals, unsuitable cleaners, abrasive cleaning, or corrosive conditions.
Water behavior. Condensation, mist, splashing, wind-driven rain, water carried through open louvers, temporary dripping after operation, overflow caused by debris or inadequate property drainage, and minor water entry inherent in a louvered roof. A pergola is a water-management system, not a watertight roof or habitable enclosure. This exclusion does not eliminate coverage for a proven factory defect in a covered component.
Unauthorized additions or loads. Hammocks, swings, flowerpots, fixtures, fans, heaters, screens, roofing, solar equipment, decorations, or other objects added to or suspended from the pergola unless expressly approved in the signed project documents and installed at an approved attachment location. The structure is not designed to support unapproved added loads.
Misuse and third-party work. Accident, abuse, negligence, improper care, abnormal use, improper power supply, improper drainage, improper storage, owner installation, relocation, alteration, repair, modification, or work by others, but only to the extent the condition or work caused or contributed to the claimed failure or materially interfered with inspection or repair.
Consumables and appearance. Batteries, remote-control batteries, fuses, bulbs not identified as covered LED components, sealants, caulk, gaskets subject to routine replacement, ordinary scratches, dents, surface wear, cosmetic irregularities, color variation, and an inability to provide an exact replacement color or design.
Code or site conditions. A system not installed according to the approved enVision engineering and applicable code; changes in law or code after installation; concealed or inaccurate site information; or a property condition outside enVision’s contracted scope.
Wind-load and hurricane-rating clarification
Any statement that a system is hurricane rated, wind rated, engineered, or code compliant describes design criteria under specified engineering assumptions, including the approved configuration, foundations, attachments, exposure category, installation, and louver position. It is not a promise that the system is indestructible, that it will withstand every storm condition, or that storm or hurricane damage is covered by this warranty. Project-specific sealed engineering controls if it differs from general marketing or product literature.
How to submit a claim
Notice. Notify enVision within thirty days after discovering the suspected defect, or within any longer period required by applicable law, through envisionpergola.com, by email to service@envisionpergola.com, or by calling 800.601.5024 for submission instructions.
Claim information. Provide the purchaser’s name, installation address, approximate installation date, contract or invoice number if reasonably available, a description of the issue and discovery date, photographs or video, and reasonable maintenance information relevant to the claim. Failure to provide a particular document will not defeat an otherwise valid claim if enVision can reasonably verify eligibility by other means.
Review. enVision will ordinarily acknowledge the claim within thirty days. enVision may request additional information, remote testing, safe access, or a reasonable on-site inspection before determining coverage. Any inspection will be scheduled as soon as reasonably practicable; acknowledgment is not an acceptance of coverage.
Preservation. Do not discard the affected component or perform nonemergency alteration or repair before enVision has a reasonable opportunity to inspect. Emergency action may be taken when reasonably necessary to protect persons or property, but the owner should document the condition before and during that work. Coverage may be denied only to the extent prior work causes the claimed condition or materially prejudices investigation or remedy.
Manufacturer-administered products. Claims involving heaters, screens, fans, or other manufacturer-warranted products must be submitted to the manufacturer under its separate warranty. enVision may provide available purchase information or reasonable administrative assistance but does not assume the manufacturer’s obligations or pay shipping, labor, service, or installation costs.
Construction-defect procedures. This claim process does not waive any applicable statutory pre-suit notice or inspection process, including Florida Statutes Chapter 558 when applicable.
Limitations of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE REPAIR, REFINISHING, REPLACEMENT, OR COMPONENT REFUND DESCRIBED ABOVE IS THE OWNER’S EXCLUSIVE REMEDY FOR BREACH OF THIS LIMITED WARRANTY. ENVISION WILL NOT BE LIABLE UNDER THIS WARRANTY FOR LOSS OF USE, LOST PROFITS, LOST BUSINESS, BUSINESS INTERRUPTION, DELAY, DOWNTIME, SUBSTITUTE PRODUCTS, LOSS OF REVENUE, DIMINUTION IN PROPERTY VALUE, OR ANY SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Nothing in this warranty excludes or limits liability that cannot lawfully be excluded or limited, including any nonwaivable rights concerning personal injury, fraud, gross negligence, product liability, building-code obligations, or statutory consumer remedies.
Implied warranties and state-law rights
TO THE EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED IN DURATION TO THE APPLICABLE EXPRESS WARRANTY PERIOD FOR THE COMPONENT AT ISSUE. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
This warranty gives you specific legal rights, and you may also have other rights that vary from state to state. Any provision prohibited by applicable law will be enforced only to the maximum extent permitted, and the remaining provisions will remain effective.
Other terms
Entire warranty. This document is the complete written limited product warranty issued by enVision for the covered components. No employee, salesperson, installer, dealer, or representative may alter or extend it. A change is effective only if contained in a written amendment signed by an authorized enVision officer. This provision does not eliminate any express warranty or nonwaivable right created by applicable law.
No third-party beneficiaries. Except for a person entitled to enforce nonwaivable rights under applicable law, this warranty creates rights only for the eligible original purchaser.
Governing law and venue. Except where prohibited by applicable law, this warranty is governed by Florida law without regard to conflict-of-law principles, and any action relating solely to this warranty must be brought in a state or federal court with jurisdiction in Sarasota County, Florida. Any mandatory consumer venue or governing-law right remains unaffected.
Severability. If a provision is held invalid or unenforceable, it will be modified only to the minimum extent necessary, and the remainder of the warranty will remain in effect.
